Product Liability Insurance

Product liability insurance is essential
The Consumer Protection Act 1987 includes the provisions for Product Liability and is effective for those provisions from 1 March 1988 . It creates a strict liability for damage caused by defective products. Damage is defined as death or personal injury or any loss of or damage to any property including land.

Who is Liable for products ?
Liability for damage caused, wholly or partly, by a defect in a product. These are:-

The "producer", i.e. manufacturer, abstracter etc. (in the case of raw materials) or processor

Any person putting his name or logo on a product

Importers of products from countries outside the EC

The Consumer protection act also states that if any person who supplied a product cannot identify the sources, they will be liable for any damage.
